Can unemployment be received in NYS if you are fired or will the employer fight it?

They said they would fight it. I havent worked there since Dec. 06. I recently applied for unemployment and I received a questionnaire on who fired me and so on. Should I even bother to continue the process?

Yes continue. I work in personnel at the moment and there are times when we have fired a person who get benefirts granted. For instance, we fired a gal due to excessive absences (I'm talking not showing up for days at a time). She gave us no excuse, but when she filed, she claimed she had health problems and an abusive live-in boyfriend. She got her unemployment, but had she come to us and been open about everything, she could have saved her job. Long-winded answer...file it anyway!

Reply:In most states you are not entitled to unemplyment after being fired
Reply:being fired or laid off almost always gives you unemployment. reasons it would be denied is if you were fired for something illegal (like drugs, stealing etc).


the questionairre is normal process...unemployment simply uses it to verify info.

Reply:It all depends on the reason you were fired. Lets say you were in a fight, but you had a very good reason to fight, self defense, the administrative law judge will take this in account, remember, law is based on reason. Yes, continue the process, many employers fight the ex-employee simply to scare them off, and it is working with you.
