I recently filed a small claim for £500 to local court - had a letter and not sure what it means?

I filed the case, defendent owing the £500 filed a defence in full stating he does not owe the money. his defence consited of 5 lines saying " i told him it was non refundable deposit and i have had enough of this!"





Since this was submitted, i filled in court questionnaire and added further details to my claim.





Yesterday i hada letter from the court from the judge saying a "Statement of order" to have defence struck off as no real likelyhood of success.





What does this mean, what do i do now and will the defendent know this now. Can he appeal.

Reply:The last two people who have posted seem to have misread your question. You stated that you received an Order which said that the DEFENCE should be struck out. That is great news for you. That means that the Judge thinks that the Defendant's case has no real prospect of success. This means that you should be able to get judgment entered in your favour for £500, if this has not already been done. I would speak to the court office to find out about the correct procedure.





The Defendant will know about the Order as it will be sent to him. He will be able to apply to have it set aside, or he can appeal the Order. He might try to do one of those things whilst you are applying for judgment.





In response to your additional information, what this means is that the Defendant can apply to have the Judge's order set aside, and the usual time limit for doing this is 7 days. That means the case will go for a hearing in the County Court and the Defendant will have to persuade the Judge why the Order should be set aside. He will have a good chance of getting it set aside if he can show that he has a good Defence. He does not need to show that the Judge was wrong to make the Order in the first place, only that it would be in the interests of justice for the Order to be set aside.





If he does not ask for it to be set aside, he has the alternative of appealing against the Order to a Circuit Judge of the County Court. He would be unlikely to win an appeal, because he would have to show that the Order was wrongly made in the first place, and it sounds like that would be difficult for him to do.





Anyway, you do not need to worry about what he may or may not do, you could just apply for your judgment, and you could also ask for your costs, e.g. court fee. If the Defendant does not pay up he will have an unsatisfied County Court Judgment (CCJ) on his record and that will affect his ability to get credit. If he does not pay up you can ask for the judgment to be enforced, and any further costs you incur in doing this can be added to the judgment debt.
Reply:it means he has no money to pay you and your wasting your time and will be a fortune for court fees for the claim to go ahead.
Reply:It would seem that the Judge has looked at the file and considered there is no likleyhood of you getting the judgement.


When you were paying for the goods or services, was there a clause indicating 'no refund'? If so, you have no case if this is a private transaction with another individual. If it is with a Company, the situation is different e.g. Merchantable Quality, Fit for Purpose etc.


The only avenue you have now is a Private Prosecution in the County Court but beware, beacuse if you lose there and this is likley, costs would be awarded to the Defendant, making you well out of pocket.

One cell (no border) for the question. Cell next to it (or underneath) with no border except for the bottom line of the cell. Pick color/line thickness via table properties.

I am involved in UK small claims proceedings. The defendant turned up at the last hearing with a witness that I knew nothing about because I had not been served with a copy of the allocation questionnaire. What is the law in Indiana on a parent receiving information???

Are the parent's of a child entitled, by law, to gain any information they require about their child and the environment their child is in (as long as that information doesn't involve another student, b/c it would break the other childs right for privacy)? I had a questionnaire I asked for the teachers and principal to fill out so I can better understand the structure of their school, the environment my child is in, and how my child responds to different situations in that environment. Is it legal for the principal to just decide for the teachers to not give me that information? I read some of the laws, and it sounded like I was entitled to the information I desire to have.... anyone know this one??? =) Thank you!

the principal has the final decision...i am up in fishers and we had something very similar happen a few years ago...you might have to take this to the school board...however, i am not sure that your efforts will make any difference

I would think that they would be more than willing to give up information on your child's school environment because you will hear from your child what happens and how they're responding. To know this stuff in advance or to know what your chld is not telling you would help both you and the school. Take it to the school board. You're going to find out anyways, why not give it up now before it causes problems?
Reply:I work in fort wayne and you can request and information and long as you are the legal guardian. You can also request for a tour of the school and to sit in on some of your child's classes to better understand what there day is like. If you child receives special service (esl, special ed) you are sup post to get meeting called IEP's to come up in ideas to better suite your child educationally. I hope this helps

No, he paid his debt..though it's disgustingly little (most women don't get anything, though)


Plus, there is a thing called statute of limitations. I believe it is 7 years and once tried and convicted cannot be tried again.


If she took him to civil court for pain and suffering, she may or may not get anything. Usually statute on the wrong done is only 2 years I think.

Reply:I'm sure it's standard letter that goes out to all athletes. Those that are interested will take the time to answer, those that aren't interested won't bother like you. Don't sweat it. I'm sure hundreds went out. If you don't answer, it's no big deal.
Reply:Well if your absolutely positive that your not gunna go to the school i think its ok not to respond to it. Its not rude because people cant be forced to reply to stuff. Dont worry about it and just live your life as you were. A lot of people recieve questionnares and dont respond im sure the college coach is perfectly used to it. Reply:If those are the types of drink sold in cans at your school, then that's good. Does it matter if the drinks are actually in cans? If so drop off any that don't come in cans. The sample is the people you ask. Be sure to do this randomly. Don't just ask the oldest class in the school for example. Ask as many as you can (sample size) because that gives more reliable results.

I am making a questionnaire at work to give our clients to fill out... I have figured out how to put our company's logo on it and I have typed all of the questions. What I want to know is, is there a way that I can insert text boxes under each question that our clients can fill in without disrupting the format of my document? I really need this done by tomorrow and I am in a seriuos jam...any help would be greatly appreciated..I also have InDesign and Photoshop on this computer if they would be more useful.

You should just be able to insert a text box from the "Insert" menu option at the top of the screen.





If this does not do the trick just use "Drawing" toolbar to draw in a standard rectangle.

I have to write a report based on a questionnaire (Lickert Scale) about levels of environmental concern vs egoistic concern.


The questionnaire was distributed amongst a group of 1st psych students. Below the questionnaire were further questions enquiring about gender, first language, employment, voluntary work etc. I am confused as to whether these are ALL considered independent variables, whilst the mean (catergorised- egoistic vs environmental) concern scores are considered dependent variables.

Those would be considered independent variables. The best way to think of it is this: What variable are you looking at as the output? What variable is the one you are looking at to answer the question? That is your dependent variable. All the ones that are "input" to answer that are independent.





Demographic questions are usually used to create groups of responders in order to compare one group to another (e.g. "Did men and women show the same level of observed difference?").

First of all, you don't want to be biased- or have hidden biased. This is one issue that should be considered. Sometimes, questionnaires can have hidden bias in the questions that are asked or the way they are asked.
Reply:simplicity. Make the questions short. Allow for short answers. Too much text is a turn off.
Reply:The prime concern is whether or not your respondants can understand your question. So simplicity and clarity in the design of questions is imperative.


Then you have to check for bias -- make sure your question isn't of the 'did you stop smoking because it was a vile disgusting habit?' type, or the non-sequetir of the 'have you stopped beating your wife' genre. In other words, your question must be phrased so it doesn't invite a particular answer, but rather is open enough that the respondant can be either for or against without feeling intimidated.


There should also be control questions. These are questions that you can predict the asnwers for, just to make sure someone isn't joking around with their responses. And then you can add verifying questions. Phrase the same question two or three different ways to see if you get the same answer each time.

Reply:Yes your GP will have all of your medical record from birth. They will sent back to main holding when you move doctors then transferred to your new doctors.

Also since records are now pretty much fully computerised and should be fully summarised, significant conditions like epilepsy will be at the top of the summary, so they can't be missed.

It's not the pubs that are the concern, it's the poor non-smokers that'll benefit.
Reply:My city's smoking ban will go into effect next January '08. I'm very happy. I will start going to more pubs for their great food and smoke-free atmosphere. I can't wait.

Hopefully any business pubs lose from smokers will be made up by people who wouldn't have gone to them with smokers in them.

I want to dye my hair so that the red tones come out, what should I use?

I normally use Clairol's Natural Instincts, and a couple of years ago I dyed my hair a color that gave me a lot of red tones, and it's still that way now. I don't like the red/golden tones in my hair that you see in the light, and I want to bring out my brown tones more. I have naturally brown hair. The thing is, in some places, depending on lighting, my hair already looks dark brown (inside my house, for instance). But outside and at class, my hair looks very medium brown - red/gold. I went on Clairol's site and took a questionnaire where I picked my current color, (medium brown) and then selected that I wanted a new color to get rid of these red/gold tones. It came up with "Clove- Medium Ash Brown" but I hear stories about making your hair green or gray looking. I only do semi-permanent dyes, and I'm willing to do a demi if needed. Should I use this color or go to a stylist and pay the cash to have them dye it whichever they reccomend to get rid of these tones?

If you're very serious about your hair and the color it turns out, I would invest the money in going to a salon. It's unlikely that the color from a salon will turn out to be not what you want, and if they do screw up, it's on them. Not you. But if you're in a stage in your life where you can experiment more with your hair, I would say try the at home stuff. It's cheaper and ususally works. If you ever want highlights and are doing them at home I found something that works great, a toothbrush! It'll give you a mixture of thickness in the highlights, and nothing too chunky.
Reply:Pick one of the colours you like, avoiding anything that says "Golden" or, of course "red/reddish" ... Personally, I also avoid "ash" because it comes out almost greenish, but some people can use ash. Maybe try for the ones that say "natural", "ash" or "beige". :)
Reply:I would recomend a demi color thats a simple ash brown leave this on your hair for 35-40 mins wash out only towle dry it. ... The green base in the demi should counter act the red...Every time you tint your hair alway look what the base color is
Reply:You can buy (same isle as color) a color remover. Use it then redo your color. I think red and gold tones come through naturally with most colorings.
Reply:Boo-boo green! Nothing says look at the red tones in my hair than boo-boo green. You should try it. On the contrary, life deals you bigger fish to fry other than the color you should be dying your hair. What you should be asking is, how do I end world hunger and bring about world peace.

A good suicide questionnaire?

Are there any good questionnaires out there, for friends of someone they believe is suicidal or for someone who believes they are themselves? I can't seem to find any good ones, so any help would be appreciated.

If the person is talking about ending it all, hurting themselves, giving up... you don't need a questionnaire to figure out that they are asking for help.





If they are talking about death, writing about death or asking for help in causing their death they need help, do not delay call 911 take them to hospital get them help anyway that you can.





This is not something that you alone can fix they need professional help.

Reply:Well you kind of answered this one yourself, byt saying that the person in question , even thinks that they are suicidal. So that would be good enough for me, or the police, or a therapist. Then next question would be how would you do it, if they have an answer to that then you need to get your friend to a ER, or call the local crisisline and have them meant them at that the locla hospital where they can talk to them, and find out what they are thinking, and how they would do it. It is better to stop it right now then to let it go on any longet then it already has. Then i would suggest that that person gets into therapy and work through the issues that he/she may have that has brought them to this point in life. If they have a plan and know just how they would do it, then they are sudical and they should be in treatment now, not later. To get help that would keep them amoug the living. So that they can get the help that they need.

1. Talk with dog owners- perhaps spend an hour at a dog park and see what people recommend for your family


2. Make sure you know what your time commitment will be for the dog to make sure that you actually want a dog


3. Look at your options of rescue


- rescue groups will tell you if the dog is good for your family


- they do house checks and you fill out an application


-can be cheaper than buying from a breeder

Please, after making your decision upon what dog breed to get, do not buy from a puppy mill. Please look on the web and in local papers for a responsible breeder and do not support the puppy mills. Even though the puppy is cute in the pet store, if you can't see the conditions it was bred and raised in, you don't know if you are buying a lot of problems, or a good pet. If you can't meet the parents, see the puppy in it's present home, then it might be because it is a sketchy place. A breeder might charge more than a puppy mill sadist, but the pet you get will be more than worth the extra $.
